The process of European integration is a path undertaken by a significant number of countries of the 'old continent' for the construction of an economic, political and juridical space; an area capable of responding to the demands of competitiveness imposed by the globalization and the interdependence between the different national realities. An evolution of supra-national relations at the European level which, even in the face of its original vocation to a mere economic collaboration between the States, has also ended up involving the subject of the fundamental rights of the human person. In fact, as the political and legal integration efforts have proceeded, in the drafting of the Treaties that have implemented the European unity, the definition of a true catalog of inalienable freedoms has taken place; a catalog in which the right of religious freedom has assumed a central position (similar to what was codified in the parallel supranational system of the Council of Europe). Even though, in the current regulatory framework, the European Union has no jurisdiction regarding the juridical discipline of the religious phenomenon, it has nevertheless consolidated a growing attention to the spiritually characterized interests, together with the exercise of direct competences for the purposes of protection of freedom of thought and faith.
Il processo di integrazione europea costituisce un cammino intrapreso da un numero significativo di Paesi del ‘vecchio continente’ per la costruzione di uno spazio economico, politico e giuridico in grado di rispondere alle esigenze di competitività imposte dalla globalizzazione e dall’interdipendenza tra le diverse realtà nazionali. Un’evoluzione dei rapporti sovranazionali a livello europeo che, pur a fronte della sua originaria vocazione alla mera collaborazione economica fra gli Stati, ha finito per coinvolgere anche la materia dei diritti fondamentali della persona umana. Infatti, al procedere degli sforzi di integrazione politica e giuridica si è accompagnata, nella redazione dei Trattati che hanno implementato l’unità europea, la definizione di un vero e proprio catalogo delle libertà inalienabili, in cui il diritto di libertà religiosa ha assunto una collocazione centrale (alla pari di quanto codificato nel parallelo sistema sovranazionale del Consiglio d’Europa). Anche se, nell’assetto normativo vigente, l’Unione Europea non ha alcuna competenza quanto alla disciplina giuridica del fenomeno religioso, si è, tuttavia, consolidata una crescente attenzione per gli interessi spiritualmente caratterizzati, unitamente all’esercizio di competenze dirette ai fini della tutela delle libertà di pensiero e di fede.
