Sport appears more and more increased by episodes of racial discrimination and anti-Semitic and xenophobe violence. The emergence of this pathological degeneration of “sporting spirit” urges more consideration about remedies which guarantee recognition of fundamental rights to foreign (labeled as ‘different’) in this area as well as in every area of public life. On the one hand, this study makes an analysis of recent Italian Court ruling concerning numerous episodes of intolerance during sport events; on the other hand, the same study focuses one’s attention on particular discriminatory circumstances regarding non-EU citizen athletes (especially the “clauses of citizenship” provide by the sport federal regulation). The enforcement of national and European laws permits to care for the ‘degrading’ conducts, offering to everyone the necessary respect for human dignity and recognition of fundamental rights.
