The article studies the foreign, especially American legal experience compared with the Italian legal system in the matter of protection of rights in the Constitution. The research moves from the observation that Rulemaking power and adjudication are expressions that the American legal literature has deepened for a long time, highlighting the distinction between the two institutes that in the Italian legal experience have been brought under the sole feature of the activity of "regulation". On the other hand, in the United States legal system, the activities of the independent agencies, which, in our legal system, the doctrine leads to only one qualification, that of regulation, have been clearly distinguished, identifying two different legal frameworks which relate respectively to the procurement and regulatory activities
L’articolo studia l’esperienza giuridica straniera, specialmente, americana posta a confronto con l’ordinamento italiano in tema di tutela dei diritti nella Costituzione. La ricerca muove dalla osservazione che rulemaking power e adjudication sono espressioni che la letteratura giuridica americana ha approfondito da tempo, evidenziando la distinzione tra i due istituti che nell’esperienza giuridica italiana sono stati ricondotti sotto l’unico tratto dell’attività di “regolazione”. Viceversa nell’ordinamento degli Stati Uniti le attività delle Agenzie indipendenti, che, nel nostro ordinamento, la dottrina riconduce ad una sola qualificazione, quella di regolazione, sono state nettamente distinte, individuando due distinte discipline giuridiche aventi ad oggetto rispettivamente l’attività di aggiudicazione e l’attività di regolazione.
