UNITÀ E INDIVISIBILITÀ DELLA REPUBBLICA: LA SOVRANITÀ POPOLARE E L’INTERDIPENDENZA NEL NOME DELLA COSTITUZIONE

The paper aims to place the «requirements of autonomy» ex article 5 of the Constitution in the context of a constitutional reading of the unity and the indivisibility of the Republic. The interpretation proposed reads in the supreme principle of the indivisibility of the Republic an inviolable limit, not only by the formal territorial secession, but also by the substantial secession of fragments of the people. From this perspective, the contribution looks at the ongoing implementation of article 116, paragraph 3, of the Constitution.

Il contributo intende collocare le «esigenze dell’autonomia» ex art. 5 Cost. nell’alveo di una lettura di contenuto costituzionale dell’unità e indivisibilità della Repubblica. L’interpretazione proposta legge nel principio supremo dell’indivisibilità della Repubblica un limite inviolabile, non solo dalla formale secessione territoriale, ma anche dalla sostanziale secessione di frammenti del popolo. In quest’ottica il contributo guarda all’attuazione in corso dell’art. 116, comma 3, Cost.
