The paper aims to discuss on the transformation of the citizenship focusing on migrations. If the State has the legislative power on the criteria for the attribution of national citizenship, Regions are responsible for a large part of social rights. Beside the State formal citizenship, it is therefore possible to identify a “substantial citizenship” assigned to Regions. Particularly qualifying for this sort of “regional citizenship” is the sector of immigrant integration, that involves all social competencies of the Regions. Both citizenships, national and regional, are however strictly connected to the criteria for recognizing the active participation of foreign residents in the life of the local community. In this respect ambiguity arises, nowadays, on the residence criteria conceived as registration in municipal population Registers.

Il saggio si propone di ragionare sulle trasformazioni della cittadinanza a partire dalle migrazioni. Se lo Stato è responsabile dei modi di acquisto della cittadinanza statale, le Regioni sono competenti di una parte significativa dei diritti sociali. Accanto alla cittadinanza formale di competenza statale è possibile, quindi, individuare una “cittadinanza sostanziale” affidata alle Regioni. Particolarmente qualificante per questa sorta di “cittadinanza regionale” è il settore dell’integrazione degli immigrati, che coinvolge l’insieme delle competenze sociali delle Regioni. Entrambe le cittadinanze, quella statale e quella regionale, sono tuttavia strettamente connesse ai criteri formali con cui far valere la partecipazione alla convivenza sul territorio. Sotto questo profilo si mette in evidenzia l’ambiguo ruolo che attualmente svolge il criterio della residenza, concepito come iscrizione nei registri anagrafici dei Comuni.
