his paper analyzes the reasons for the current academic and political interest in The Nomos of the Earth, discussing Schmitt’s interpretation of the rise and fall of European public law and its significance for an accelerating globalization. The argument proceeds in four steps: first, it considers problems in translating the term nomos; then it discusses the gaps in the cosmic historical vision underlying The Nomos of the Earth; the third part analyzes Schmitt’s conceptions of anarchy and nihilism; the concluding section argues that The Nomos of the Earth’s outstanding contribution lies in its critique of legal positivism and legalistic formalism.
