The new rules implementing the Italian Code of Public Procurement in the defence sector are positively marked by the definitive overcoming of the traditional specialtỳ of regulating procedures (tenders and contracts) and contracts concluded by bodies of the Ministry. However, in addition to common profiles, there are also profiles of marked differentiation with respect to the general discipline. These are the persistent prerogatives of the served apparatus, from the exclusivity on the economic utility of the assets to the wide discretionary power to choose the procedures, to the lack of external controls, up to the concentration of the most relevant powers in Geniodife. In times of spending review and growing Europeanisation of defence, the opportunity to affect a significant item of the public budget through a broad implementation of the principles of transparency, participation and accessibility of the procedures, recognized at a global level, is lost.
Le nuove norme che attuano il Codice degli appalti pubblici nel settore della difesa si segnalano positivamente per il definitivo superamento della tradizionale specialità di disciplina delle procedure (appalti e affidamenti) e dei contratti conclusi da organi del Ministero. Permangono, tuttavia, accanto ai profili di comunanza, anche profili di marcata differenziazione rispetto alla disciplina generale. Si tratta di persistenti prerogative dell’apparato servito, dall’esclusiva sulle utilità economiche dei beni all’ampia discrezionalità di scelta delle procedure, alla mancanza di controlli esterni, fino alla concentrazione dei poteri più rilevanti in capo a Geniodife. In tempi di spending review e crescente europeizzazione della difesa, si perde l’occasione di incidere su una voce significativa del bilancio pubblico attraverso un’ampia attuazione dei principi di trasparenza, partecipazione e accessibilità delle procedure, riconosciuti a livello globale.
