The article takes its cue from the Consiglio di Stato's Plenary Assembly's ruling no. 8 of 2006 on the exclusive jurisdiction over public services, to formulate general considerations on the evolutionary lines of the Italian administrative system. In particular, it emerges, on the one hand, the deference of the supreme judges towards the teaching of the Constitutional Court on the criteria of exclusive jurisdiction, and on the other, the peculiarity of the revirement of the highest body of administrative justice, with regard to the health system. Both data highlight the tendency, which indeed persists beyond the borders of that system, to preserve and, if possible, strengthen the idea of an authoritarian and discretionary administrative action.
L'articolo prende spunto dalla pronuncia dell’adunanza plenaria del Consiglio di Stato, n. 8 del 2006, sulla giurisdizione esclusiva in materia di servizi pubblici, per formulare considerazioni generali sulle linee evolutive del sistema amministrativo italiano. In particolare, emerge, da un lato, la deferenza dei supremi giudici verso l’insegnamento della Corte costituzionale sui criteri della giurisdizione esclusiva, dall'altro, la peculiarità dei revirement dell’organo di vertice della giustizia amministrativa, con riguardo all’ordinamento sanitario. Entrambi i dati evidenziano la tendenza, invero perdurante oltre i confini di quell’ordinamento, a preservare e, se possibile, rafforzare, l’idea di un agire amministrativo autoritario e discrezionale.
