The paper examines the evolution of advance directives in the European context in light of the growing attention to the person’s rights in end-of-life choices. The role of the European Court of Human Rights in assessing the compliance of national legislation with the European Convention is analysed, with particular reference to the cases Parfitt v. United Kingdom and Lambert et autres v. France, relating to the interruption of vital treatments. The essay also reconstructs the contribution of European organisations, notably the Council of Europe, in defining informed consent as an essential element of the care relationship.
