La natura normativa del decreto "Carburanti" del Ministero delle Imprese e del Made in Italy

In its ruling of 10 November 2023, no. 16777, the Lazio Regional Administrative Tribunal declares the illegitimacy of the Ministerial Decree of 31 March 2023, concerning, among others, the obligation to display the average reference prices by the managers of fuel distribution. In particular, the administrative judges, identifying the nature of normative act of the mentioned Decree, recognize the violation of Law no. 400/88, and in particular the violation of the rules governing the procedure for adopting the normative acts of the Executive.

La sentenza del Tar Lazio del 10 novembre 2023, n. 16777, annulla il Decreto ministeriale del 31 marzo 2023, avente ad oggetto, tra gli altri, l’obbligo di esposizione dei prezzi medi di riferimento da parte dei gestori degli impianti di distribuzione del carburante. In particolare, i giudici amministrativi, individuando nel Decreto impugnato la natura di atto normativo, ravvisano la violazione della L. 400/88, ed in particolare nelle norme che disciplinano il procedimento di adozione degli atti normativi dell’Esecutivo.
