On the fortieth anniversary of the signing of the Villa Madama Agreements, representing a decisive moment in the bilateral relations between the State and the confessional organizations in the process of adaptation to the new constitutional legality, it is possible to outline the main trends characterizing the implementation of the treaty principle before and after the Concordat review. Starting from 1984, a new season of relations between civil and religious authorities began which involved, first of all, the Catholic Church and, simultaneously, some historic confessional denominations present in Italy. This is in a system of mutual interactions that has developed not only on the traditional level of top relations between the State power and the ecclesiastical institutions (particularly the Catholic ones), but also in the dimension of the peripheral relations in the local administrative realities. There has been a strong use of the treaty form, from which all the religious confessions have benefited, albeit with differentiated degrees between them in terms of the enjoyment of rights and powers of action.
Nel quarantennale della firma degli Accordi di Villa Madama, rappresentanti un momento decisivo dei rapporti bilaterali tra lo Stato e le organizzazioni confessionali nel percorso di adeguamento alla nuova legalità costituzionale, è possibile delineare le principali tendenze caratterizzanti l’attuazione del principio pattizio prima e dopo la revisione concordataria. A partire dal 1984 si è aperta una nuova stagione delle relazioni tra autorità civili e religiose che ha interessato, innanzitutto, la Chiesa cattolica e, simultaneamente, alcune storiche denominazioni confessionali presenti in Italia. Ciò in un sistema di interazioni reciproche che si è sviluppato non solo sul piano tradizionale dei rapporti di vertice tra potere statale ed istituzioni ecclesiastiche (in particolare quelle cattoliche), ma anche nella dimensione dei rapporti periferici nelle realtà amministrative locali. Si è determinato un forte ricorso al modulo pattizio, di cui hanno beneficiato tutte le confessioni religiose, pur se con graduazione differenziate tra esse quanto al godimento di diritti e facoltà di azione.
