The reform of the 'Third Sector' marked a clear point of discontinuity with respect to the traditional consideration of the solidarity initiatives by civil society as a residual phenomenon compared to the intervention of the State and the Market. The codification of a new and uniform discipline of the entities that are dedicated to the social solidarity has provided a precise legal identity to a reality which, for many years, has had a defining matrix only on a socio-cultural level. In this sense, the analysis of the innovations brought by the legislator from the labor perspective can be useful to verify the opportunities and the limits of a reform which has established a stable transmission chain between the world of production and that of non-profit activities (also ideally and religiously characterized), urging the labor law to broaden its protection instruments to models of organization of the human activity that are different from those usually practiced in the commercial enterprises.
La riforma del ‘Terzo Settore’ ha segnato un netto punto di discontinuità nei confronti della tradizionale considerazione delle iniziative solidaristiche della società civile come fenomeno residuale rispetto all’intervento dello Stato e del Mercato. La codificazione di una nuova ed uniforme disciplina delle entità dedite alla solidarietà sociale ha fornito una precisa identità giuridica ad una realtà che, per molti anni, ha disposto di una matrice definitoria soltanto sul piano socio-culturale. In questo senso, l’analisi delle innovazioni apportate dal legislatore nella prospettiva lavoristica può essere utile a verificare le opportunità e i limiti di una riforma che ha istituito una catena di trasmissione stabile fra il mondo della produzione e quello delle attività senza scopo di lucro (anche idealmente e religiosamente caratterizzate), sollecitando il diritto del lavoro ad allargare i suoi strumenti di tutela a modelli di organizzazione dell’attività umana diversi da quelli usualmente praticati nell’impresa commerciale.
