Current legal protection measures, including the support administration, sometimes don’t prove to be the most appropriate for the concrete needs of the beneficiaries. There are many cases of people – such as dependent older adults – who are frail and in need of care and assistance but who, at the same time, show a tendency towards transparency and autonomy in decision-making. In such hy- potheses, the Trust could represent a valid negotiating alternative, offering an elastic and flexible solution that respects the independence and dignity of the per- son. The private nature of the institution would make it possible, by the principle of subsidiarity, to implement the protected mandatory interest by replacing the judge in regulating an appropriate measure to pursue the objectives of protection, care and assistance of the vulnerable person, guaranteeing more excellent protec- tion and confidentiality of the beneficiary.
