In introducing the crime under Article 612 ter of the Italian Criminal Code, known as “revenge porn” by the general public, the lawmaker acted on the emotional wave and popular outrage, in the face of episodes of relevant gravity and persistent social alarm, attempting to calibrate criminal protection, in the absence of previous adequate instruments, on the actual “scope,” also on the socio-cultural level, of the practices of illicit dissemination of sexual content. This was an almost inevitable opportunity to intervene with a new norm: the paper then tries to verify whether such diligence in taking charge of the problem, appreciable and entirely plausible, has then generated a legislative output sufficiently organic and really capable of dealing with virtual violence or whether the novelty, as it would seem, has resolved itself, because it lacks an overall vision and a real perspective of effectiveness.

Nell’introdurre il reato ex art. 612 ter c.p., colloquialmente noto come “revenge porn”, il legislatore ha operato sull’onda emotiva e dello sdegno popolare, a fronte di episodi di peculiare gravità e persistente allarme sociale, tentando di calibrare la tutela penale, in assenza di precedenti strumenti adeguati, sull’effettiva “portata”, anche sul piano socio-culturale, delle pratiche di diffusione illecita di contenuti sessuali. Si è trattato di un’occasione quasi inevitabile per intervenire con una nuova norma: il lavoro prova allora a verificare se tale solerzia nel prendere in carico il problema, apprezzabile e del tutto condivisibile, abbia poi generato un prodotto legislativo sufficientemente organico e davvero capace di fronteggiare la violenza virtuale oppure se la novella, come sembrerebbe, si sia risolta in sé stessa, perché priva di una visione d’insieme e di una reale prospettiva di effettività.
