Abstract

The protection of the dependent older adults poses significant challenges. The prohibition of age discrimination and the need for flexible protection instruments call for a critical reflection on the adequacy of current legal protection measures, including support administration. In this context, trust emerges as an effective negotiating alternative, offering an elastic and flexible solution that respects the autonomy and dignity of the person. The work explores the dynamic nature of the institution, its role in assisting and protecting vulnerable persons, and its function in estate planning. Analysing its constitutive structure and objectives, the trust’s ability to conform to the particular needs of each individual emerges, ensuring management of assets and assistance to the vulnerable person that can be truly «tailor-made».
