Il cambiamento strutturale del diritto pubblico europeo e la costruzione di una società europea democratica

This paper focuses on the topic of the structural change of European public law that contributed to the emergence and progressive construction of the European democratic society, which is the subject of Armin von Bogdandy’s latest book. The main issue is the relationship between society and jurist-interpreters, on the role of legal science (judges, practitioners and legal scholars) and of the legal culture of origin of jurist-interpreters at this historical turning point as well as in ages of intense socio-economic and political change.

Il contributo approfondisce il tema del cambiamento strutturale del diritto pubblico che in Europa ha contribuito all’emergere e alla progressiva costruzione della società democratica europea, oggetto della tesi esposta nell’ultimo libro di Armin von Bogdandy. Il focus è in particolare sul rapporto tra società e giuristi-interpreti, sul ruolo della scienza giuridica (giudici, operatori e studiosi del diritto) e della cultura giuridica d’origine dei giuristi-interpreti in questo tornante storico come nelle epoche di intenso cambiamento economico-sociale e politico.
