La “vecchia” fattispecie di epidemia: un’arma spuntata al tempo del Covid-19

In the context of the pandemic emergency, the use, by the legislator, of criminal sanction has resulted, among other things, in the “exhumation” of the (old) epidemic offense, hitherto little explored and characterized by rather uncertain operating margins. This contribution analyzes the reference discipline, originating from articles 438 and 452 of the Criminal Code, reconstructing the interpretative problems that revolve around the legal nature of the crime and the structural elements that make it up, in order to test its applicability to the unprecedented Covid-19 epidemic.

Nel contesto dell’emergenza pandemica l’utilizzo, ad opera del legislatore, della sanzione di tipo penalesi è concretizzato, tra l’altro, nella “riesumazione” della (vecchia) fattispecie di epidemia, sinora poco esplorata e connotata da margini operativi piuttosto incerti. Questo contributo ne analizza la disciplina di riferimento, originata dagli artt. 438 e 452 c.p., ricostruendo le problematiche interpretative che ruotano attorno alla natura giuridica del reato e agli elementi strutturali che lo compongono, al fine di te- starne l’applicabilità alla inedita vicenda epidemica da Covid-19.
