Migranti lgbt. Tutela della persona e meccanismi di protezione

The essay deals with the issue of the vulnerability of migrants so-called lgbt who arrive in Italy because they are persecuted in their country of origin for their sexual orientation and/or sexual identity. The work examines the procedure used by Italy to ascertain sexual orientation and aimed at obtaining protection from the applicant, in order to highlight the inconsistencies as they are detrimental to the dignity of the person. The inadequacy of the mechanism emerges from the absolute discretion of the institutional agents in examining applications for protection; the judgment, too often based on personal convictions, leads to decisions that are detached from the evaluation of the specific case and that differ from the fundamental principles and the overall logic of the system and its normative values.

Il saggio affronta il tema della vulnerabilità dei migranti c.dd. lgbt che giungono nel territorio italiano perché perseguitati nel loro Paese d’origine a causa del loro orientamento sessuale e/o identità sessuale. Il lavoro esamina la procedura utilizzata dall’Italia per l’accertamento dell’orientamento sessuale e volta ad ottenere la protezione da parte del richiedente, mettendone in luce le incongruenze in quanto lesiva della dignità della persona. L’inadeguatezza del meccanismo emerge dall’assoluta discrezionalità degli agenti istituzionali nell’esame delle domande di protezione; il giudizio, basato troppo spesso su convincimenti personali, conduce a decisioni disancorate dalla valutazione del caso concreto e difformi rispetto ai princípi fondamentali e alla logica complessiva del sistema e dei suoi valori normativi.
