The essay examines the issues related to foreigners’ entry and stay in the national territory. The concept of dignity, which reflects the personalist principle, can be used to affirm the complete equality between citizens and foreigners, rejecting any form of discrimination based on personal conditions. In the perspective of dignity, due attention has been given to the institution of family reunification in favor of the families of foreign minors who are already in the State’s territory, in order to guarantee their best psychophysical development. In this respect, the interest of the minor acts as a guiding principle whenever, under the specific circumstances, it is necessary to safeguard his right to family unity, which prevails over the State’s interest to control the territory.
Il saggio affronta la tematica connessa all’ingresso e alla permanenza degli stranieri nel territorio nazionale. Attraverso il concetto di dignità, quale riflesso del principio personalista, è possibile affermare la totale equiparazione tra cittadini e stranieri, rifiutando qualsiasi forma di discriminazione fondata su condizioni personali. Nell’ottica della dignità è stato analizzato l’istituto del ricongiungimento familiare a favore dei familiari dei minori stranieri già presenti nel territorio dello Stato, al fine di garantire il loro corretto sviluppo psicofisico. In tal senso, l’interesse del minore funge da principio guida tutte le volte in cui, in riferimento al caso concreto, sia necessario salvaguardare il suo diritto all’unità familiare che prevale cosí sull’interesse dello Stato al controllo del territorio.
