This article deals with the issue of access to land as one of the most recurring causes of the migratory phenomenon. Access to land, a right often denied in the places of origin of migrants, is also a call that pushes individuals to abandon their native lands in search of a “land” in which to settle. Land is, in fact, a special good that generates resources, offers funding and sustenance, allows the carrying out of work activities but is also at the center of conflicts and hoarding and commodification practices. The investigation is carried out by analyzing the relationship between land and work, as emerges from a reading of the art. 44 of the Constitution, up to addressing the most current issues of circular immigration and illegal hiring in rural areas.

Il presente articolo affronta il tema dell’accesso alla terra come una delle cause più ricorrenti del fenomeno migratorio. L’accesso alla terra, diritto spesso negato nei luoghi di provenienza dei migranti, costituisce altresì un richiamo che spinge gli individui ad abbandonare le terre native alla ricerca di una “terra” ove stabilirsi. La terra è, infatti, un bene che genera risorse, offre stanziamento e sostentamento, consente lo svolgimento di attività lavorative ma è anche al centro di conflitti e di pratiche di accaparramento e commodification. L’indagine viene compiuta analizzando il rapporto tra terra e lavoro, così come emerge da una lettura dell’art. 44 Cost., fino ad affrontare i temi più attuali dell’immigrazione circolare e del caporalato nelle aree rurali.
