The study examines the structural dimension of new contractual relationships taking place through collaborative platforms offering mixed services. The analysis shows the possibility of classifying collaborative platforms both as internet service providers and, at the same time, as offline service providers. It follows that applicability of the sectoral legislation and of the Directive No 2000/31 EC on e-commerce is cumulative and not alternative. The dual classification of collaborative platforms would make it possible to ensure a homogeneous framework of consumer protections without neglecting the relevance of the requirements laid down in the transport sector regulation. All the interests involved must be taken into account, not only the conflicting interests of traditional operators and platforms, but also those of consumers who would be guaranteed a high level of protection in this case.

Lo studio esamina la dimensione strutturale dei nuovi rapporti contrattuali che si svolgono mediante collaborative platforms che offrono servizi misti. Dall’analisi emerge la possibilità di classificare le piattaforme collaborative sia come internet service providers sia, al contempo, come fornitori dei servizi offline. Ne consegue l’applicabilità cumulativa e non alternativa della normativa di settore e della dir. n. 31 del 2000 sull’e-commerce. La duplice qualificazione delle piattaforme collaborative consentirebbe di garantire un quadro omogeneo di tutele per i consumatori senza tralasciare la rilevanza dei requisiti previsti dalla normativa del settore dei trasporti. Occorre tenere conto di tutti gli interessi coinvolti, non soltanto quelli confliggenti degli operatori tradizionali e delle piattaforme, ma anche quelli dei consumatori cui verrebbe assicurato, in tal caso, un elevato livello di protezione.
