The paper, in the analysis of the possible application outcomes of the art. 550 of the Civil Code deepens some peculiar questions related to the so-called “cautela sociniana” remedy. Given the absence of a legislative provision, it deals with the actual operating methods with which the legitimate can exercise the remedy in case of several legacies. It addresses the issue of indivisibility on the passive side and the assessment of the right of usufruct in relations between the beneficiaries of bequests. Concerning the interpretation of the art. 550, paragraph 2, of the Civil Code considers reviewing the generally recognised solution from a perspective more adherent to the legislative data. At the same time, the proposed solution should be more suitable to balance all the interests involved reasonably, prioritising the adequate protection of the testamentary will. Finally, the essay examines the eligibility of a testamentary clause based on the exact operating mechanism provided by the art. 550 of the Civil Code. On the operational level, the latter’s purpose is to diversify the inheritance treatment of the legitimate.
Il lavoro, nell’analisi dei possibili esiti applicativi dell’art. 550 c.c., approfondisce alcune questioni peculiari attinenti al rimedio della c.d. cautela sociniana. Data l’assenza di una previsione legislativa, ci si interroga sulle effettive modalità operative con le quali il legittimario possa esercitare il rimedio in presenza di piú disposizioni a titolo particolare. Sono affrontati i temi della indivisibilità sul lato passivo e della capitalizzazione del diritto di usufrutto nei rapporti tra legatari. Con riferimento all’interpretazione dell’art. 550, comma 2, c.c. si ritiene che la soluzione generalmente riconosciuta vada rivista in una prospettiva piú aderente al dato positivo e, al contempo, idonea a bilanciare in modo ragionevole tutti gli interessi coinvolti, dando prevalenza all’effettiva tutela della volontà testamentaria. Si riflette, altresí, sull’ammissibilità di una clausola testamentaria, costruita mutuando sul piano effettuale il meccanismo operativo della cautela sociniana, al fine di diversificare il trattamento successorio del legittimario.
