Gestione dei rifiuti ed economia circolare nella giurisprudenza della Corte Costituzionale

The essay proposes a new "bivalent" interpretation of the constitutional jurisprudence in the matter of waste collection and management because the author shows that waste is intended by the Council not only as a factor of environmental pollution and, therefore, devolved to the exclusive jurisprudence of the State but, also, like "energetic derivatives" in the production of the nuclear energy and, therefore, like energetic resources devolved to the concurrent legislative power of the State and the regions.

Il saggio propone una nuova chiave di lettura “bivalente” della giurisprudenza costituzionale nella materia della raccolta e della gestione dei rifiuti perché l’autore dimostra che i rifiuti sono intesi dalla Consulta non solo come fattore di inquinamento dell’ambiente e, perciò, devoluti alla giurisprudenza esclusiva dello Stato ma, anche, come “derivati energetici” nella produzione dell’energia nucleare e, quindi, come risorse energetiche devolute alla potestà legislativa concorrente dello Stato e delle regioni.
