The paper analyses the role and the content of the health care professional’s obligation to provide information to the patient and examines the liability connected with its violation. The attention is particularly focused on the health care professional’s duty of selecting and communicating to the patient only the information that are most appropriate, according to circumstances of the case, in order to allow him to express his consent to the medical treatment.
Il contributo analizza ruolo e contenuto dell’obbligo di informazione gravante sul sanitario e i profili di responsabilità civile in caso di sua violazione. L’attenzione è focalizzata, in particolare, sul dovere del medico di selezionare e comunicare al paziente esclusivamente quelle informazioni che, secondo le circostanze del caso concreto, risultino le piú adeguate sí da consentirgli di manifestare con consapevolezza il proprio consenso o diniego al trattamento sanitario
