The aim of this paper is to assess the relationship between women’s and social question in liberal Italy, focusing on the juridical debate on the admission of women to the role of legal guardian. In the late Nineteenth century, when deep transformations affected the Italian society, the prohibition enforced by article 268 of Civil Code, revealed a series of unresolved contradictions that marked the issue of women’scitizenship throughout the new century.
Il presente esamina il rapporto tra ‘questione femminile’ e ‘questione sociale’ nell’Italia liberale, analizzando in particolare il dibattito concernete l’ammissione della donna all’ufficio tutelare. A fronte delle tumultuose trasformazioni che investivano la società italiana alla fine dell’Ottocento, il divieto posto per la donna ad assumere il munus tutelare, sancito nel codice civile del 1865, rivelava una serie di contraddizioni irrisolte destinate a segnare il tema della cittadinanza femminile ben oltre il tornante del nuovo secolo.
