Codatorialità e responsabilità del datore di lavoro nelle reti di imprese

The essay deals with the issue of joint employership, analyzing some questions that arise when admitting a multi-employer relationship. In particular, the A. focuses on the meaning of the term joint employership, on the liability regime applicable to co-employers, wondering on whether or not co-employment is compatible with the case of subject networks. In order to provide an answer to these issues main strands of thought are analyzed, in an evolutionary perspective and in the current debate, relating to the notion of employer, to the admissibility of an idea of co-employership, to the employer’s responsibilities.

Il saggio affronta il tema della codatorialità, analizzando alcune questioni che emergono dall’ammissione di un rapporto di lavoro multi-datoriale. In particolare, l’A. si sofferma sul significato da attribuire al termine codatorialità, sulla compatibilità o meno della stessa con la fattispecie della rete soggetto, sul regime di responsabilità applicabile ai codatori di lavoro. Per tentare di fornire una risposta a tali questioni vengono analizzati i principali filoni di pensiero, nella prospettiva evolutiva e nel dibattito attuale, relativi alla nozione di datore di lavoro, all’ammissibilità di una scomposizione della figura datoriale, alle tecniche di imputazione del rapporto.
