The matter is companies that provide public services to the community on behalf of a public entity and are with the effort to dodge the growth and stability pact regulation, the public accounting rules as well as the rules set on competition proofing. Against such a background, the work illustrates the negative impact that a phenomenon based on a self serving interpretation of European Jurisprudence is having on the whole economic and legal environment. That impact has, possibly, been worsened by some recent pronouncements of the Corte di Cassazione on the theme of action for liability against directors, that, while intended to prevent the misuse and waste of public funds might end up favoring it controlled by the latter as if they were its internal bodies.
