With decision nr. 589/1999 the Third Civil Section of the Italian Supreme Court of Cassation had qualified medical liability in terms of a liability which is contractual in nature. Since the end of the 20th century, using the concept of “social contact”, the Italian case law has been applying the lex contractus to various types of liability, evoking themes deeply linked to the German literature. According to the so-called “Gelli-Bianco” Law (Law No. 24 of March 8, 2017), medical liability is based on tort, pursuant to Article 2043 of the Italian Civil Code. The new professional responsibility of health professionals has provoked a lively debate, that deserves to go into it more deeply. The Coronavirus pandemic poses unprecedented challenges to Medical malpractice law. The paper will finish by looking that the Coronavirus pandemic represents a «problem of special complexity» and, therefore, it is mandatory to apply art. 2236 of the Italian Civil Code.
Con la sentenza n. 589/1999 la terza sezione civile della Corte di Cassazione italiana aveva qualificato la responsabilità del medico in termini contrattuali. Dalla fine del XX secolo, utilizzando il concetto di «contatto sociale», la giurisprudenza italiana ha applicato la lex contractus a diverse tipologie di responsabilità, evocando temi profondamente legati alla dottrina tedesca. Ai sensi della c.d. legge “Gelli-Bianco” (Legge 8 marzo 2017 n. 24), la responsabilità medica si fonda su un illecito aquiliano, ai sensi dell’articolo 2043 del codice civile. La nuova responsabilità dei professionisti sanitari ha suscitato un vivo dibattito, che merita approfondimento. La pandemia di Coronavirus pone sfide senza precedenti alla disciplina della colpa medica. Il contributo termina osservando che la pandemia di Coronavirus rappresenta un «problema di particolare complessità» e, pertanto, è obbligatorio applicare l’art. 2236 del codice civile italiano.
