The Covid-19 epidemic that hit Italy and the whole world has upset our lives in a very short space of time, also putting a strain on the strength of our democratic system. As a result, numerous legal questions have arisen, especially in reference to the limitations of the constitutional freedoms that some governmental measures, enacted on several occasions, have brought to the attention of the jurist. Among the measures taken to deal with the pandemic emergency, a significant public debate (at the most diverse levels) has taken place with reference to the restrictive provisions of freedom of worship. This by virtue of the importance that religious freedom, with its manifestations, receives in our constitutional system, from which derives the need to guarantee the right of the individual affiliates to meet with other people in order to be able to carry out the cult practices envisaged by their own creed. A right that, due to its specific and pre-eminent constitutional value, can be compromised only in certain circumstances and with all the necessary protections.
L’epidemia di Covid-19 che ha colpito l’Italia ed il mondo intero ha stravolto, in un brevissimo lasso di tempo, le nostre vite, mettendo anche a dura prova la tenuta del nostro sistema democratico. Di conseguenza, si sono poste numerose questioni di natura giuridica, soprattutto in riferimento alle limitazioni delle libertà costituzionali che i provvedimenti governativi, emanati a più riprese, hanno posto all’attenzione del giurista. Fra le misure adottate per far fronte all’emergenza pandemica, un significativo dibattito pubblico (ai più diversi livelli) si è avuto in riferimento alle disposizioni limitative della libertà di culto. Ciò in virtù dell’importanza che la libertà religiosa, con le sue estrinsecazioni, riceve nel nostro ordinamento costituzionale, da cui discende l’esigenza di garantire il diritto dei singoli consociati di riunirsi con altre persone per poter eseguire le pratiche cultuali previste dal proprio credo. Un diritto che, per il suo specifico e preminente valore costituzionale, può essere compresso solamente in determinate circostanze e con tutte le tutele del caso.
