Religious faith is a human behavior that can be perceived in all spatial and temporal latitudes, and the public institutions have never failed to engage in it. In Italy, the religious phenomenon is governed by the Constitution and by a highly articulated legislation, both old and recent, although not entirely in conformity with the framework of contemporary pluralist democracy. In this sense, the model of the contracted legislation between the State and the religious denominations has promoted, in the practice and in the normative production, the tendency to identify in the institutionalized spiritual groups the expression of the public dimension of the religious phenomenon, which should instead be traced back to the religious feeling generally understood. This is in order to propose an interpretation of constitutional norms on religious freedom in line with the central objective of the development and improvement of the human person, all the more important in view of the meaningfulness and the irreversibility of the migratory flows (and of the resulting ethical-religious pluralism) that are characterizing the Italian and european social space.
La religiosità costituisce un comportamento umano rilevabile a tutte le latitudini spaziali e temporali, e le istituzioni pubbliche non hanno mai omesso di interessarsene. In Italia il fenomeno religioso è disciplinato dalla Costituzione e da una articolatissima normazione, antica e recente, anche se non tutta conforme al quadro della democrazia pluralista contemporanea. In questo senso, il modello della legislazione contrattata tra lo Stato e le confessioni religiose ha favorito, nella prassi e nella produzione normativa, la tendenza ad individuare nei gruppi spirituali istituzionalizzati l'espressione della dimensione pubblica del fenomeno religioso che, invece, andrebbe rintracciata nel sentimento religioso genericamente inteso. Ciò al fine di proporre un'interpretazione delle norme costituzionali in materia di libertà religiosa in sintonia con l'obiettivo centrale dello sviluppo e del perfezionamento della persona umana, tanto più importante di fronte alla significatività e all'irreversibilità dei flussi migratori (e del conseguente pluralismo etico-religioso) che stanno caratterizzando lo spazio sociale italiano ed europeo.
