The cultural heritage of religious interest, on a systematic point of view, may well be considered as an expression of identity shared values of civilizations between the State and the religious denominations, in the common logic of their instrumentality to improve and to support the improvement of the human personality. However, this value-reciprocity has been transfused into a legislative framework, whose recent development has given us the image of a State legislator plagued by indecision's regulatory and hypertrophic legislation. Repeated innovations, changes and afterthoughts have contributed to propose a dense backdrop of uncertainty, for the purpose of a complete legal arrangement of the protection of the ecclesiastical art-historical patrimony. After more than sixty years of inaction, the competition between covenantal law, unilateral State sources, in the form of ordinary and regional laws, and the reform of Title V of the Constitutional Charter has been characterized by a continued insistence on the principle of cooperation between public authorities and religious organizations that, in its widespread articulation and in its incessant development, might lend itself to a deformation of the correct allocation of the respective responsibilities of the State and the spiritual groups. in this subject.
I beni culturali di interesse religioso, sul piano sistematico, possono ben considerarsi come espressione di valori identitari condivisi di civiltà tra lo Stato e le confessioni religiose, nella logica comune della loro strumentalità al miglioramento e al perfezionamento della personalità umana. Tuttavia, questa reciprocità valoriale si è trasfusa in un quadro legislativo, il cui sviluppo recente ci ha consegnato l'immagine un legislatore statale afflitto da indecisioni regolamentative ed ipertrofia normativa. Ripetute innovazioni, modifiche e ripensamenti hanno contribuito a delineare uno scenario denso di incertezze, ai fini di una compiuta sistemazione giuridica della tutela del patrimonio storico-artistico ecclesiastico. Dopo oltre sessant’anni di immobilismo, il concorso fra normativa pattizia, fonti unilaterali statali, nella forma di leggi ordinarie e regionali, riforma del Titolo V della Carta costituzionale si è caratterizzato per una continua insistenza sul principio di collaborazione tra pubblici poteri ed organizzazioni confessionali che, nella sua diffusa articolazione e nel suo incessante sviluppo, potrebbe prestarsi ad una deformazione della corretta allocazione delle rispettive competenze dello Stato e dei gruppi spirituali in questa materia.
