The monograph focuses on the deepening of the constitutional dimension of levels of material benefits for citizens. The subject substantially neglected by Italian doctrine, however, finds attention in the foreign doctrine that has studied the substantive economic profiles of the phenomena governed by constitutional and public law. In particular, the monograph deals with the study of material public action because the doctrine has denied legal relevance to the material profiles of the activities of the public authorities by giving an absorbing attention only to the provisions or procedural profiles leaving in the shadow cone the profiles, of greater importance for citizens, disorganisation and malfunctioning in the practical exercise of the public authorities downstream of public measures. In the first chapter, the autonomous legal relevance of material public which is systematically placed alongside the concept of the measure and, therefore, not as a mere execution of the same without autonomous legal relevance is isolated. In the second chapter we reconstruct with arguments of positive law, logical and systematic, public action as a whole, in order to construct a final theory of public action capable of bringing to light alongside the procedure for issuing the measure the procedure for its implementation as a sub-procedure of the single procedure for the production of the public action by the public administration. The third chapter examines the substantive and procedural claims of the citizens, the addressees of public administration decisions, in the face of the inertia of the public administration in the execution of its decisions. In essence, this part of the research studies the actions which can be taken vis-à-vis the public administration which is inactive in the execution of its decisions favourable to individuals, in application of the constitutional principle ubi ius ibi remedium, which, in turn, is based on the Articles. 24 and 103 Cost. Despite the absence of a typical action of fulfillment against the inert public administration, it reconstructs a real action of condemnation to a State of the public administration in the event of failure to implement the decisions issued. The research concludes with an analysis of the problems related to the legal standing to act to protect the interests of the superindividuals, in case of dysfunctions or disorganizations of the public authorities. The analysis of the evolution of the doctrine and the legislation of the sector have made it possible to indicate the criteria for identifying the legitimacy to act both of the individual citizen and of the collective bodies, in case of inertia of the public administration.
La monografia ha ad oggetto lo studio dell’azione pubblica materiale nella Costituzione perché la dottrina ha negato rilevanza giuridica alla nozione dei profili provvedimentali dei pubblici poteri riservando un’attenzione solo residuale alle disorganizzazione e disfunzioni nell’esercizio concreto materiale dei pubblici poteri a valle dei provvedimenti pubblici. Nel primo capitolo è isolata l’autonoma rilevanza giuridica dell’azione pubblica materiale che viene collocata sistematicamente accanto alla nozione autonoma e, quindi, non come esecuzione dei provvedimenti priva di rilevanza giuridica autonoma. Nel secondo capitolo si ricostruisce con argomenti di diritto positivo, logico e sistematico, l’azione pubblica nel suo complesso, al fine di edificare una teoria finalistica dell’azione pubblica, all’interno della quale viene distinto un autonomo sub procedimento di esecuzione materiale dei provvedimenti rispetto al sub procedimento di emanazione dei provvedimenti. Il terzo capitolo studia la pretesa sostanziale e processuale dei cittadini, destinatari delle decisioni della pubblica amministrazione, di fronte all’inerzia della pubblica amministrazione nella esecuzione delle proprie decisioni. In sostanza, questa parte della ricerca studia le azioni esperibili nei confronti della pubblica amministrazione inerte nella esecuzione delle proprie decisioni favorevoli ai privati, in applicazione del principio costituzionale ubi ius ibi remedium, che, a sua volta, si fonda sugli artt. 24 e 103 Cost. Pur in assenza di un’azione tipica di adempimento nei confronti della pubblica amministrazione inerte, si ricostruisce una vera e propria azione di condanna ad un facere della pubblica amministrazione in caso di omessa esecuzione delle decisioni emanate. La ricerca si conclude con l’analisi dei problemi attinenti alla legittimazione ad agire a tutela degli interessi superindividuali, in caso di disfunzioni o disorganizzazioni delle pubbliche autorità. L’analisi dell’evoluzione della dottrina e della legislazione di settore hanno consentito di indicare i criteri di individuazione della legittimazione ad agire sia del singolo cittadino, sia degli enti collettivi, in caso di inerzia della pubblica amministrazione.
