The Protection Consortia address, as is noted, a rather significant part of the sale of quality products within the national and European agro-food markets. The Legislative Decree of 8 April 2010, n. 61 again calls attention to the prime activity of Protection Consortia, specifically in wine growing sector, that is to protect the production quality in order to guarantee to consumers a quality that conforms to the reputation of the trade-name. At the same time, by a series of rules, the Legislative Decree, implicitly confirms the Interprofessional nature of the organisms under examination and introduces the validity “erga omnes” principle. This Legislative Decree also establishes new rules for the minimum operative and representative requirements necessary for optimal functioning of the same Consortia. Moreover the Legislative Decree n. 61/2010, specifically art. 17, traces the allocation of the functions assigned to the Consortia that are divided between the monitoring and the protection and safeguarding of the trade-name prevalently performed in the commercial phase and during verification.
