In the analysis of the relationship between the Constitution and the multicultural developments of the social community, the reality of an ethnic, religious and cultural pluralism, determined as a consequence of the massive migratory phenomena that have affected the European countries, as a whole, and Italy, specifically, is reflected. This transformation of the social structures is critically perceived as a drift of the factual experience, since in it, alongside ‘traditional’ models of life, there has been, for example, the appearance of different concrete forms in the way of being citizens and in the family life. This has led to the request for the recognition of ‘new’ rights of freedom against majority conducts or claims and to the appearance of alternative ‘political questions’, including of an institutional change. In this framework of accentuated ideal and cultural pluralism, we question the capacity of responsive force of the Constitutional Charter and the idea of the Constitution as a legal basis of the collective identity and sharing of a common ethos, in the dimension of the realization of the fundamental rights of the human person.
Nell’analisi del rapporto tra la Costituzione e gli sviluppi in senso multiculturale della comunità sociale viene a riflettersi la realtà di un pluralismo etnico, religioso e culturale, determinatasi in conseguenza dei massici fenomeni migratori che hanno interessato i Paesi europei, nel loro complesso, e l’Italia, nello specifico. Questa trasformazione degli assetti sociali è avvertita criticamente come una deriva dell’esperienza fattuale, in quanto in essa, accanto a modelli di vita ‘tradizionali’, si è registrata, ad esempio, la comparsa di forme concrete diverse del modo di essere consociati e della vita familiare. Ciò ha condotto alla richiesta del riconoscimento di ‘nuovi’ diritti di libertà contro condotte o pretese maggioritarie e alla comparsa di alternative ‘domande politiche’, anche di cambiamento istituzionale. In questo quadro di accentuato pluralismo ideale e culturale, ci si interroga sulla capacità di forza responsiva della Carta costituzionale e sull’idea di Costituzione quale base giuridica dell’identità collettiva e di condivisione di un ethos comune, nella dimensione dell’inveramento dei diritti fondamentali della persona umana.
