In the belief that the secular State must present itself as a point of convergence of the different ideologies, without assuming any as its own, a reflection on the framing of the canon of secularism in a non-ideological key is considered useful. That is, its evaluation as a 'method' and as an attitude of public powers to enhance, within the broad framework of the constitutional legality, the different cultural and religious options in absolute neutrality. A conception of the constitutional secularism as a methodology for governing the social complexity fueled by the cultural diversity of the contemporary societies and implementing the democratic pluralism through a balanced mediation between different the ideal positions. Only the use of a secular 'method' can allow us to objectively evaluate the inevitable interrelationships between religious dynamics and religiosity and applied law, to verify how the current legal instruments are concretely used and to identify which of these allow not only to satisfy the different involved interests, but also to outline rules capable of being accepted by all, regardless of the different beliefs and faiths of the social members.
Nella convinzione secondo cui lo Stato laico debba porsi come punto di convergenza delle diverse ideologie, senza assumere alcuna come propria, è da ritenersi utile una riflessione sull’inquadramento del canone della laicità in una chiave non ideologica. Ovvero una sua valutazione come ‘metodo’ e come attitudine dei poteri pubblici a valorizzare, nel quadro ampio della legalità costituzionale, le diverse opzioni culturali e religiose in assoluta neutralità. Una concezione della laicità costituzionale come metodologia di governo della complessità sociale alimentata dalle diversità culturali delle società contemporanea e di attuazione del pluralismo democratico attraverso una equilibrata mediazione tra le diverse posizioni ideali. Solo il ricorso ad un ‘metodo’ laico può consentire di valutare obiettivamente le inevitabili interrelazioni tra dinamiche religiose e della religiosità e diritto applicato, verificare come gli strumenti giuridici vigenti vengono concretamente utilizzati e individuare quali tra questi permettono non solo di soddisfare i diversi interessi coinvolti, ma anche di delineare regole capaci di essere accettate da tutti, indipendentemente dalle differenti convinzioni e fedi dei consociati.
