The article explores the principle of the relativity of contractual effects and third-party beneficiary contracts in the Peruvian Civil Code, comparing it with the Italian Civil Code. It highlights how both codes govern contractual relativity, meaning that contracts produce legal effects only between the contracting parties and not towards third parties, except as provided by law. The article also examines third-party beneficiary contracts, where a third party can benefit from rights without being a party to the contract, and the various ways such contracts can operate within the Peruvian and Italian legal contexts. Emphasis is placed on the importance of the interest of the stipulator and the beneficiary, as well as the potestative rights of acceptance, revocation, and modification of the benefit provided by the Peruvian Civil Code.
Questo lavoro tratta del principio di relatività degli effetti del contratto e del contratto a favore di terzi nel c.c. peruviano, analizzando le similitudini e differenze rispetto al c.c. italiano. Si evidenzia come entrambi i codici disciplinino la relatività contrattuale, per cui i contratti producono effetti giuridici solo tra le parti stipulanti e non nei confronti dei terzi, salvo eccezioni previste dalla legge. L’articolo esamina inoltre il contratto a favore di terzi, dove un terzo può beneficiare di diritti senza essere parte del contratto, e le varie modalità con cui tali contratti possono operare nel contesto giuridico peruviano e italiano. Viene posto particolare accento sull’importanza dell’interesse dello stipulante e del terzo beneficiario, nonché sui diritti potestativi di accettazione, revoca e modifica del beneficio previsti dal c.c. peruviano.
