Towards a Hermeneutical Approach to Legal Metaphor

This paper examines the importance of metaphor in legal discourse. It discusses the reasons for the lack of specific studies of the relevance and structure of metaphors in the law in general, and in Italian constitutional law in particular. Three claims are put forward: 1) legal discourse is constituted by a mobile army of metaphors; 2) there is no such a thing as a non-metaphorical legal language; and 3) strong ideological prejudices work against a recognition of the basically metaphorical nature of legal concepts. The paper examines the rhetorical conception of metaphor and then summarizes the three dominant theories of metaphor: semantic, structuralist and hermeneutic, and argues that only a hermeneutical approach can grasp and fuse the cultural horizons of inherited, metaphorical, interpretive traditions. It concludes that comparative law, with its work of translation, is an excellent standpoint for examining the values underlying legal metaphors.

Questo articolo ricostruisce le origini della riduzione della metafora a figura retorica, quindi discutetre indirizzi della moderna metaforologia: il paradigma semantico, quello strutturalista e quello ermeneutico4. Il saggio sostiene tre tesi: (1) che il linguaggio, e dunque anche il linguaggio giuridico, è costituito da un esercito mobile di metafore, da metafore che rimandano ad altre metafore, (2) che non esiste un linguaggio non metaforico, e (3) che vi sono una serie di pregiudizi, carichi di ideologia e falsa coscienza, che si ribellano a tale visioni, quali – tra gli altri – l’illusione di una sostanza oggettiva dietro le apparenze soggettive, di una sostanza ontologica dietro la parvenza linguistica, di una struttura economica sotto una sovrastruttura giuridica, di un rigore scientifico contro una vaghezza poetizzante.
