Licenziamento e superamento del periodo di comporto

The essay deals with the dismissal of the employee during the so called «time of respite», which is the length of time the worker can keep his job while he’s off sick. The Author analyzes the several legal issues related with the topic, with special regard to the most influencing case law and the legal consequences of the unfair termination of the contract as they are described by the Fornero Act and the Jobs Act.

Il saggio è volto ad analizzare le conseguenze del licenziamento intimato dal datore di lavoro nei confronti del lavoratore durante il periodo di comporto. L’analisi prende le mosse dal dettato normativo dell’art. 2110, co. 2, c.c., approfondisce i principali indirizzi giurisprudenziali e dottrinali in materia, soffer- mandosi sui cambiamenti che hanno interessato l’istituto e che sono intervenuti sia nel diritto vivente, con diverse pronunce della Corte di Cassazione, che in quello positivo, con la l. n. 92/2012 e, da ultimo, con il d.lg. n. 23/2015
