The right to religious freedom is recognized and protected by our democratic system as an expression of the identity of the human person, both believer and non-believer, and constitutes an inalienable and representative value of ideal and cultural pluralism. It is an inviolable right which has an absolute and unconditional nature, as an expression of freedom of conscience, and which must also be guaranteed to the child, to the extent that religious experience is recognized as a founding element of his personality and of the way in which he relates to the world. The evolution of the concept of the relationship between parents and children has affected the methods of exercising parental authority, determining the need to protect the right of the minor to an educational path that allows him to mature the useful degree of discernment for determining himself independently. In this direction, both doctrine and jurisprudence (on merit and legitimacy) have contributed to promoting a vision of the educational function as aimed at forming individuals that are capable of free and conscious options also in religious matters, on the basis of the conferring on minors significant spaces for decision-making autonomy and the pursuit of their best interests.
Il diritto di libertà religiosa è riconosciuto e tutelato dal nostro ordinamento democratico come espressione dell’identità della persona umana, sia credente che non credente, e costituisce un valore irrinunciabile rappresentativo del pluralismo ideale e culturale. Si tratta di un diritto inviolabile che ha carattere assoluto ed incondizionato, quale espressione della libertà di coscienza, e va garantito anche al fanciullo, nella misura in cui l’esperienza religiosa viene riconosciuta come elemento fondante della sua personalità e del modo in cui egli si rapporta con il mondo. L’evoluzione della concezione del rapporto tra genitori e figli ha investito le modalità dell’esercizio della potestà genitoriale, determinando la necessità di tutelare il diritto del minore ad un percorso educativo che gli consenta di maturare il grado di discernimento utile a determinarsi in modo autonomo. In questa direzione, sia la dottrina che la giurisprudenza (di merito e di legittimità) hanno contribuito a promuovere una visione della funzione educativa come protesa a formare individui capaci di opzioni libere e coscienti anche in materia religiosa, sulla base del conferimento ai minori di significativi spazi di autonomia decisionale e del perseguimento del loro best interest.
