The work, in retracing the latest directions of jurisprudence on the subject of organized activities for the illicit trafficking of waste, pursuant to article 452 quaterdecies of the Criminal Code, highlights the still controversial aspects of the law, proposing – de iure condendo – a legislative review of the offense, so as to remedy in particular the defects of the description of its constituent elements and deal with the distortions that derive from the extension to the crime of the typical repressive measures foreseen by the system for the fight against «mafias».
Il lavoro, nel ripercorrere gli indirizzi ultimi della giurisprudenza in tema di attività organizzate per il traffico illecito di rifiuti, ex art. 452 quaterdecies c.p., evidenzia i profili ancora controversi della fattispecie, ipotizzandone – de iure condendo – una rivisitazione «a monte», per via legislativa, così da rimediare in particolare ai difetti della tecnica normativa e far fronte alle distorsioni che derivano dall’estensione al reato delle misure repressive classiche previste dall’ordinamento per il contrasto alle «mafie».
