New challenges for the legal profession have soared at the beginning of the Third Millennium. On one hand, technological tools that allow the access to statutes and case law put lawyers in competition with those who can get such data and manipulate them through AI. On the other hand, the demand for justice is growing and the role of the lawyer is still crucial for the protection of the right to a fair trial, which is a key feature of every liberal and democratic political system. The ECHR, the Charter of fundamental rights of the EU, and some national constitutions acknowledge the relevant role of the legal profession for the defense of rights and freedom, as well as for the safeguard of democratic values. In such a context it has emerged the Italian constitutional amendment for the inclusion of the role of the lawyer in the text of the constitution. Moreover, economic globalisation, migrations, and the growing transnational relationships require the lawyer to be more prepared under a cultural point of view, facing new areas of activity and adopting different kinds of organisation of its work. Nevertheless, the fundamental values of the legal profession are always the same, and the lawyer has to implement them with his scientia juris for the goal of justice and of a free and independent defense in the exclusive interest of his clients.
L’inizio del III millennio prospetta nuove sfide per la professione forense. Da un lato, le nuove forme di accesso e consultazione telematica della legge e della giurisprudenza espongono l’avvocato alla concorrenza di nuovi operatori che si avvalgono di strumenti di intelligenza artificiale. Dall’altro, la domanda di giustizia è crescente e l’intervento dell’avvocato resta l’indispensabile garanzia del giusto processo che costituisce un aspetto essenziale di ogni sistema politico liberaldemocratico. La Convenzione EDU, la Carta dei diritti fondamentali dell’U.E. ed alcune costituzioni nazionali riconoscono il ruolo cruciale della professione forense per la garanzia dei diritti e delle libertà e per assicurare una società democratica. In questo quadro si inserisce il disegno di legge italiano per la costituzionalizzazione del ruolo dell’avvocato. D’altronde la globalizzazione economica, le migrazioni, i crescenti rapporti transnazionali a tutti i livelli impongono all’avvocato di formarsi un bagaglio culturale molto più ampio e di aprirsi a nuove attività ed a nuovi modelli di organizzazione. Invariati sono però i valori cui deve ispirarsi l’avvocato, che deve unire alla scientia iuris una dedizione libera ed indipendente alla tutela dei diritti e della libertà fondamentali nell’esclusivo interesse della giustizia e dei propri assistiti.
