The essay traces the Fair Trade phenomenon from its emergence to its affirmation in the international context. The regulatory profiles are analyzed, highlighting the important contribution of self-regulation at a global level on the part of operators in the sector. It is then acknowledged the progressive interest of the European legislator for the introduction of provisions of positive law on Fair Trade, which was followed in Italy by a series of regulatory interventions culminating in the adoption of the Code of the third sector (d. lgs. n. 117/2017). The overall experience is evaluated from a comparative point of view, enhancing its role as a new model of enterprise and international trade relations in support of the poorest people and as a forerunner of movements for sustainable development.
Il saggio ripercorre il fenomeno del Commercio Equo e Solidale (Fair Trade) dal suo emergere sino alla sua affermazione nel contesto internazionale. Sono analizzati i profili regolatori, evidenziando l’importante apporto dell’autoregolamentazione intervenuta a livello globale da parte degli operatori del settore. Si dà poi atto del progressivo interesse del legislatore europeo per l’introduzione di previsioni di diritto positivo in materia di Fair Trade, cui hanno fatto seguito in Italia una serie di interventi normativi culminati nell’adozione del Codice del terzo settore (d. lgs. n. 117/2017). La complessiva esperienza è valutata in chiave comparatistica, valorizzandone il ruolo di nuovo modello di impresa e di relazione commerciale internazionale a sostegno delle popolazioni più povere e di antesignano dei movimenti per lo sviluppo sostenibile.
