Corporate Governance e Crisi dell’Impresa in tempo di Pandemia

The international spread of the Covid-19 has generated dramatic financial and social consequencesheavily affecting the global economy. The response either by national governments or financial and international regulators and organizations has showed an unexpected convergence in several economic and legal aspects, albeit in a very narrow time. Bankruptcy system has provided fertile ground for comparative and interdisciplinary analysis of various States’ approaches, often highligtning unexpected convergence in the measures adopted. Depending on the national jurisdictions, the emergency measures had different impact on the legal framework in the insolvency law and in connected subjects, sometimes proposing new paths, that may be relevant also in ordinary times. This paper inquires about the most relevant insolvency reforms taking place as a response to the global pandemic, especially in geographic areas that are contiguous in terms of legal and economic relations, such as the European Union, where this result of spontaneous harmonisaton has been particularly appreciated.
