The essay deals with the increasing internationalization of the settlement of disputes between States and foreign investors, which is reflected in the more and more frequent recourse to international arbitration and in a wider application of international law in this context. Special relevance has ICSID (International Centre for Settlement of Investment Disputes) Tribunals' arbitration, whose case law has contributed to analyse some important issues of foreign investment international law. The essay focuses, in particular, on the following topics: arbitration without privity; notion of investment; nationality of companies; distinction between treaty claims and contract claims; the most-favoured-nation treatment; prevalence of international law as law applicable to settlement of dispute.
Il lavoro prende spunto dal recente fenomeno di progressiva internazionalizzazione della soluzione delle controversie tra Stato e investitore straniero, che si è manifestata sia nel ricorso sempre più frequente all’arbitrato internazionale sia in una più ampia applicazione del diritto internazionale. In tale contesto, particolare rilevanza ha l’arbitrato dei tribunali costituiti in seno all’ICSID (International Centre for Settlement of Investment Disputes), la cui giurisprudenza ha contributo a chiarire alcune questioni centrali del diritto internazionale degli investimenti. Nel lavoro è esaminata, in particolare, la giurisprudenza dei tribunali dell’ICSID in relazione ai seguenti aspetti: l’arbitration without privity; la nozione di investimento; la nazionalità delle società; la distinzione tra treaty claims e contract claims; l’applicazione del trattamento della nazione più favorita; la prevalenza del diritto internazionale quale diritto applicabile per la soluzione della controversia.
