The essay explores the rough path that in French case-law brought about the registration of the birth certificates of the Mennesson twin sisters, who were born abroad through surrogate motherhood. It particularly focuses on the recognition of intentional parenthood, as well as on the protection of the child’s right to identity, which the Strasbourg Court prioritized when it was called upon again to decide the case, though for the first time by giving an Advisory Opinion. The decision of the French Supreme Court no. 648 of 2019 puts an end, after over eighteen years, to a long-standing dispute, recognizing the filiation between the intentional mother and the children based on the lawful registration of the birth certificate. Alternative forms (namely adoption) recommended by the Advisory Opinion would amount to a disproportionate violation of the girls’ right to private life.

Il saggio analizza il tormentato percorso affrontato dagli organi giurisprudenziali francesi in merito alla trascrivibilità degli atti di nascita delle gemelle Mennesson, nate all’estero mediante gestazione per altri. Particolare attenzione è rivolta al riconoscimento della genitorialità intenzionale, nonché alla tutela del diritto all’identità dei figli; diritto posto in primo piano dalla Corte di Strasburgo chiamata a pronunciarsi ancóra sulla vicenda, ma per la prima volta con parere consultivo. La pronuncia della Suprema Corte francese n. 648 del 2019 chiude, dopo oltre diciott’anni, la lunga querelle, riconoscendo il rapporto di filiazione tra la madre intenzionale e le figlie sulla base della legittima trascrizione dell’atto di nascita: altre modalità (adozione) suggerite con l’Advis consultatif realizzerebbero una forma sproporzionata di violazione del diritto alla vita privata delle due ragazze.
