Sull’autonomia del diritto dalla morale. A proposito di un’idea di modernità in Sergio Cotta e di alcune implicazioni sul conflitto d’interessi nel diritto positivo

Abstract: what’s the meaning of Law? This is the big question for Sergio Cotta. It implies a relationship among Law and Ethics. A recent example of all of it can be seen in Italian administrative Law (legge n. 241 del 1990). Article 6 bis sets new rules on conflict of interests. It provides to avoid conflicts of any interest, as personal interest, economic interest or financial interest, that may influence the final goal to be reached by the Public powers. So the whole system involves the idea of what might be the position of public Administration relating to such kind of interests. Should it be considered out of any contact or not? The big deal is in determining final values and kinds of conflict. So real conflict or potential conflict, and several values, as competion or public interest, can play a big role in the definition of the rule of law on this hard question.
