The Peasants Rights The United Nations Human Rights Council (UNHRC) noted the need and urgency of introducing special international legal instruments to protect peasants and those working in rural areas under the conditions of malnutrition and poverty that currently represent half of the world's population. By a specific Resolution the UNHRC, therefore, conferred a mandate on the intergovernmental working group (OEIWG), working indefinitely from 27 September 2012, with the aim of negotiating and approving a draft declaration on the rights of farmers and other people working in rural areas. According to the authoritative opinion of Oliver de Schutter, former UN Special Rapporteur on the Right to food, there are four reasons to adopt a new international instrument that protects the rights of peasants: it is necessary for international law; contributes to the fight against hunger; helps prevent subsistence farming from being overthrown by industrialized agriculture; increases access to means of production in rural areas. With this contribution, we will analyze the contents of the Draft Declaration, both as an original expression of an international law that arises from below and as a legal instrument for the protection of subjects operating in the agriculture sector.

“I diritti dei contadini” Il Consiglio per i diritti umani delle nazioni Unite (UNHRC) ha rilevato la necessità e l’urgenza di introdurre degli speciali strumenti giuridici internazionali di protezione dei contadini e di coloro che lavorano nelle aree rurali in condizioni di denutrizione e povertà che attualmente rappresentano circa la metà della popolazione mondiale. Con un’apposita Risoluzione ha, dunque, conferito un mandato al gruppo di lavoro intergovernativo (OEIWG), operante a tempo indeterminato dal 27 settembre 2012, con l’intento di negoziare e far approvare una bozza di dichiarazione sui diritti dei contadini e delle altre persone che lavorano nelle zone rurali. Secondo l’autorevole opinione di Oliver de Schutter, già Relatore speciale delle Nazioni Unite sul diritto al cibo, esistono ben quattro motivi per adottare un nuovo strumento internazionale che tuteli i diritti dei contadini: è necessario per il diritto internazionale; contribuisce nella lotta contro la fame; consente di evitare che l’agricoltura di sussistenza venga spodestata dall’agricoltura industrializzata; aumenta l’accesso ai mezzi di produzione nelle zone rurali. Con il presente contributo si analizzeranno i contenuti della bozza di dichiarazione, sia come espressione originale di un diritto internazionale che nasce dal basso sia come strumento giuridico di tutela di soggetti che operano nel settore dell’agricoltura.
