The essay explores the origins and the evolution of the prohibition of abuse of rights. Starting with an analysis of the various issues raised by scholarship and the several situations where a legal situation is exercised in contrast to its purpose, it selects the correct scope of application of such argumentative criterion, which seeks to achieve – in a context which systematically considers the variety and plurality of sources of law – a reasonable settlement of conflicts of interests under the circumstances.

Il lavoro prende in esame genesi ed evoluzione del divieto di abuso del diritto. Partendo dall’analisi dei vari profili critici esternati dalla dottrina e delle numerose fattispecie nelle quali l’esercizio della situazione giuridica soggettiva trova realizzazione in maniera contraria alla sua finalità, si giunge a scegliere la corretta portata operativa di tale criterio argomentativo, volto ad attuare – in un contesto sistematicamente orientato a considerare l’eterogeneità e pluralità delle fonti del diritto – la risoluzione ragionevole di concreti conflitti d’interessi.
