THE CONSTITUTION AS THE ARENA OF CITIZENSHIP This article presents an interpretation of the notion of citizenship that focuses on the conceptual transition that has occurred with the rise of modern constitutionalism, with special reference to the specific connotation that citizenship takes on in the Constitutions adopted after the Second World War. According to this approach, the modern principle of territoriality should imply that all the people who co-exist in a given territory should be holders of the juridical circumstances enshrined in the constitution. Hence it is not only the citizen of the State who is the recipient of the active and passive juridical instruments, but all those who are affected by the efficacy of the Constitution, foreigners included. In the light of this interpretation the author introduces the concept of “Constitutional citizenship” as foundation of State citizenship itself. Otherwise, according to the author, the efficacy of the Constitution would be subject to the decisions of ordinary legislators with an interpretation where we would be passive recipients of the juridical categories of State theory rather than exercise them. From this standpoint, by using a line of argument that involves Art. 10 of the Constitution, Article 22 and the exclusive powers of the State on citizenship and immigration - the article sets out to spot the contradictions and paradigm changes in the relationship (that is insidiously present in our legal order) between being a holder of constitutional rights and having State citizenship or not. L’articolo propone una chiave interpretativa della nozione di cittadinanza, valorizzando il passaggio concettuale dovuto all’affermarsi del costituzionalismo moderno, con particolare riferimento alla specifica connotazione che la cittadinanza assume con le Costituzioni del Secondo Dopoguerra. Nella prospettiva avanzata il moderno principio di territorialità dovrebbe implicare la titolarità delle situazioni giuridiche costituzionalmente tutelate a tutti coloro che partecipano alla convivenza nel territorio. Non è soltanto il cittadino statale, quindi, a essere il destinatario delle situazioni giuridiche, attive e passive, costituzionali ma lo sono tutti coloro che sono raggiungibili dell’efficacia della Costituzione, stranieri compresi. In questa chiave l’autrice introduce il concetto di “cittadinanza costituzionale” quale fondamento della stessa cittadinanza statale. In caso contrario, secondo l’autrice, si finirebbe per subordinare l’efficacia della Costituzione alle decisioni del legislatore ordinario e, dunque, accedere a un’interpretazione che finisce per subire più che utilizzare le categorie giuridiche della teoria dello Stato. In questa chiave l’articolo si propone di rintracciare – secondo un percorso argomentativo che coinvolge l’art. 10 Cost., l’art. 22 e le competenze esclusive dello Stato in materia di cittadinanza e d’immigrazione - le contraddizioni e i cambiamenti di paradigma della relazione, insidiosamente presente nell’ordinamento, tra la titolarità di diritti costituzionali e il possesso o meno della cittadinanza statale.
