Carlo Nardi-Greco (Naples, 1883 – Serravalle Langhe, 1944) is the author of the first work entirely dedicated to the sociology of law, entitled “Sociologia giuridica. Contributo”, i.e. “Juridical Sociology: A contribution” (Turin, Fratelli Bocca, 1907; first printing: 1906). Although the work has remained largely ignored, it is important for its intrinsic value as well as for its documentary relevance. Using the naturalistic results proffered by the fields of biology and psychology as his starting points, the author develops a historical/social research methodology in which many and various disciplinary confluent streams merge, the various tributaries surging from his vast juridical knowledge and from other scientific ambits such as anthropology, history, ethnography, sociology, economics and philosophy. After having analyzed the specific characteristics that the law takes on in various and sundry types of social aggregations, Nardi-Greco delineates the very essence of the juridical, which resides, in his view, in what he calls the “social entity”, a force which need not necessarily be politically organized. His position, in direct contrast to juridical statism, confers upon his work - phrased in positivist conceptual terms, albeit in heterodox ways at times - a clearly anti-formalistic connotation and undoubtedly innovative communicative power. And even in his inquiry with respect to the general causes which determine variations in law, Nardi-Greco aggregates motivations deriving from a psychic matrix with the economic conditions driving historical change in a multilayered - assuredly daring and yet extremely fecund - union of nature and nurture, of the doctrine of evolution and of historical materialism.

Carlo Nardi-Greco (Napoli, 1883 – Serravalle Langhe, 1944) è l’autore della prima opera interamente dedicata alla sociologia del diritto, intitolata Sociologia giuridica. Contributo (Torino, Fratelli Bocca, 1907; data di stampa: 1906).Un’opera importante per il suo valore intrinseco e per la sua rilevanza documentaria, rimasta tuttavia pressoché ignorata. In essa, l’Autore – partendo dai risultati naturalistici offerti dalla biologia e dalla psicologia, perviene ad una metodologia di ricerca di tipo storico-sociale nella quale confluiscono contributi disciplinari molteplici, attinti dalla sua cultura giuridica ed anche da altri ambiti scientifici (antropologico, storico, etnografico, sociologico, economico, filosofico). Dopo avere analizzato i caratteri specifici che il diritto assume nei diversi tipi di aggregazione sociale, Nardi-Greco delinea l’essenza stessa del giuridico che risiede, a suo avviso, nella “forza sociale”, anche non organizzata politicamente. La presa di posizione contro lo statalismo giuridico dà alla sua ricerca – fraseggiata nei termini concettuali di un positivismo a tratti eterodosso – una chiara connotazione antiformalistica ed una indubbia valenza innovativa. Anche nell’indagine delle cause generali che determinano le variazioni del diritto, Nardi-Greco coniuga motivi di matrice psichica con le condizioni economiche del divenire storico, in un connubio – certamente ardito, eppure assai fecondo – di natura e cultura, dottrina dell’evoluzione e materialismo storico.
